We never hold your money
Draft for attorney review · not yet in force
McBeth Kings does not have a trust account. We have chosen to work this way, and the Property Practitioners Regulatory Authority (PPRA) has exempted us from keeping one.
This means we never receive, hold or pass on client money. That includes rent, deposits and purchase money. We do not take it for an hour, we do not take it in cash, and we do not take it by EFT.
Why we work this way:
- Your money goes straight to the person or firm that is meant to hold it. It never sits in an agent’s account in between.
- There is less that can go wrong. No agent’s account can be emptied, frozen or misused with your money in it.
- It is easy to check. Every payment goes to an account in the name of the landlord, PayProp or a conveyancer, never to us.
Where each kind of money goes
| Money | Where you pay it | Who holds it |
|---|---|---|
| Rent (we find the tenant only: Placement) | The landlord’s own bank account, named in the lease | The landlord |
| Rental deposit (Placement) | The landlord’s own bank account, named in the lease | The landlord, who must invest it in an interest-bearing account for the tenant |
| Rent (we manage the property: Rent collection or Full care) | PayProp, into the account named in the lease. PayProp is a registered payment processing agent that holds rent and deposits in its own trust account; McBeth Kings never receives them | PayProp, which pays the landlord |
| Rental deposit (managed property) | PayProp or the landlord’s account, as the lease says | PayProp or the landlord, invested for the tenant |
| Sale deposit and purchase price | The conveyancer’s trust account (the attorney handling the transfer) | The conveyancer, until registration |
| Our fees | Our own business account, against our invoice only, or paid to us by PayProp or the conveyancer out of the client’s share | McBeth Kings |
Our own business account is used only for our own fees. It is never named in a lease or an offer to purchase as the account for rent, a deposit or the purchase price.
We never take cash
No one at McBeth Kings may accept cash for any client payment. If you pay in cash, deposit it yourself at a bank branch, ATM or pay point into the account named in your agreement, and keep the slip.
Protect yourself from payment fraud
Criminals copy agency emails and letterheads and send fake “new bank details”. This is the most common way people in South Africa lose a deposit.
Before you pay anything:
- Pay only to the account named in your signed agreement. For a sale, pay only to the conveyancer’s account.
- We will never send you new bank details by email, SMS or WhatsApp and ask you to pay into them.
- If anyone asks you to pay McBeth Kings, or to change bank details, phone 064 048 0426 before you pay. Use the number on this page, not a number in the message.
- For a sale, phone the conveyancer on a number you found yourself (for example, the firm’s website or the Law Society listing) and confirm the account before you transfer.
- If something feels wrong, stop. A real payment can always wait an hour for a phone call.
If you have already paid into an account you now doubt, phone your bank’s fraud line at once, then phone us.
McBeth Kings does not hold a trust account and will never ask you to pay any deposit, rent or purchase money into its own account. Pay only to the account named in this agreement. If anyone asks you to pay McBeth Kings or change bank details, phone 064 048 0426 before you pay.
